Bellator suing UFC citing “tortious interference of contract”

Another chapter has been added in the legal battle between the Bellator Fighting Championships and the Ultimate Fighting Championship.

Bellator Sport Worldwide LLC officials have filed suit against Zuffa in a New Jersey court, alleging that “The Ultimate Fighter 12″ cast member Jonathan Brookins joined the Spike TV reality series while still under an exclusive contract to Bellator. Brookins and his manager Mickey Dubberley were also named as defendants in the suit.

According to the suit, Brookins signed an “exclusive promotional contract” with Bellator in March 2009. He debuted with Bellator one month later, notching a submission win over Stephen Ledbetter in a non-tournament affair. Despite his initial success however, Brookins was not booked for another fight for the promotion, fighting his next two under the G-Force Fights banner, before signing on with Zuffa to appear on The Ultimate Fighter.

While the lawsuit seems to point to negligence on behalf of Brookins and Dubberley for failure to fulfill contractual obligations; Dubberley recently told MMAJunkie.com that he had been informed Brookins had been verbally released from his deal by Bellator matchmaker Sam Caplan in January.

“When I asked Sam about a fight for Jonathan Brookins and Joey Gorczynski (another fighter represented by Dubberley) back at the end of January – and both had open contracts under Bellator – Sam stated, ‘Oh, we released both those guys, but maybe in the future they could fight for us again,” Dubberley told MMAJunkie.com representatives.

There also appears to be some contention over whether or not the two fights Brookins notched under the G-Force banner were signed off by Bellator. While Bellator head honcho Bjorn Rebney contests that they were, Dubberley denies such, and cited Brookins and Gorczynski have fought under other promotional banners since then without so much as a word from Bellator and feels that Bellator merely wants to capitalize on Brookins’ appearance on the show.

“If Bellator ‘counts themselves fortunate’ to have Jonathan signed to an ‘exclusive’ deal, why would they let him fight twice in another organization and keep him inactive for over a year and have their matchmaker tell me he is released?” Dubberly asked. “We believe the only reason why Bellator is pursuing anything is because Jonathan is on the ‘TUF 12′ show, and they want to capitalize for their own profit.”

If the lawsuit is successful, Bellator could receive compensation in form of the UFC or Spike buying out the contract.
